Varying formats and sizes, printed plastic or foil with serial numbers. Condition of all indicates that they were used.

These apparently belonged to former Hoboken resident Helen Nitschke of 1242 Garden Street.

2. 2000; serial no. 16927; 2" diameter; black and white with red serial number; adhesive face.

3. 2003; serial no. 02676; oval 1-3/4" high x 3" wide; yellow with black, red serial number; adhesive face.

4. 2004, 2 examples; serial no. 02807 & 15943; 2" octagon; silver foil with green edge and frame, black lettering, red serial number; adhesive face.

ARTICLE I General Provisions

§ 190-1. Definitions.

Whenever any words and phrases are used in this chapter, the meanings respectively ascribed to them in N.J.S.A. 39:1-1 shall be deemed to apply to such words and phrases used herein.

§ 190-2. Regulations not exclusive.

The provisions of Article II, imposing a time limit on parking, shall not relieve any person of the duty to observe more restrictive provisions that prohibit or limit the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138 et seq., any other statute or as hereinafter provided.

§ 190-5. Overnight parking of commercial vehicles prohibited. [Amended 9-1-2010 by Ord. No. Z-54]

A. For purposes of this Section 190-5, commercial vehicles are defined as follows:

(1) LARGE COMMERCIAL VEHICLES — Those weighing more than four and one-half (4.5) tons or those less than four and one-half (4.5) tons with a height of more than nine and one-half (9.5) feet including installed accessories and/or a cargo area/work platform more than fourteen (14) feet in length.

(2) MEDIUM COMMERCIAL VEHICLES — Those weighing less than three and one-half (3.5) tons, less than nine and one-half (9.5) feet in height including installed accessories and/or a cargo area/work platform less than fourteen (14) feet in length.

(3) LIGHT COMMERCIAL VEHICLES — Those weighing less than two and one-half (2.5) tons and a cargo area/work platform that is less than the height of the vehicle cab and no more than nine (9) feet in length.

B. In accordance with the definitions of this Section 190-5A, no person, firm or corporation shall park any truck, bus, semitrailer pole trailer, tractor or large commercial vehicle any municipal street from the hours of 8:00 p.m. to 8:00 a.m. on any day of the week. Such prohibition shall extend and include any construction and/or excavation vehicles not occupying a bona fide job site.

C. Overnight parking of medium and light commercial vehicles owned by residents is limited to no more than two (2) and one (1) per household, respectively. Alternatively, one (1) household may park on-street overnight a maximum of one (1) medium and one (1) light commercial vehicle.

D. The posting of “No parking overnight for trailers, buses, trucks and commercial vehicles” signs shall be deemed to be notice to the owner and/or operator thereof.





§ 190-6. No stopping or standing.

A. Stopping or standing prohibited during specified times on certain streets. In accordance with the provisions of this § 190-6A, no person shall stop or stand a vehicle upon the following streets or portion thereof for the hours indicated herein:

§ 190-18. Lane use restrictions.

In accordance with the provisions of this § 190-18, all vehicles shall move in the directions as indicated herein:

ARTICLE XIV Emergency and Temporary Regulations



§ 190-26. Parking temporarily prohibited.

In accordance with the provisions of this § 190-26, no person shall park or stand any vehicle upon any streets or parts thereof in deference to an emergent or temporary regulation as posted.

A. Upon declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary emergent conditions exist with respect to highway and road conditions, weather, accidents, fires or public celebrations which dictate or require the avoidance of hazards or other conditions which interfere with the flow of traffic or safety and welfare of the general public.

B. The herein listed personnel are hereby authorized and empowered to declare an emergency and direct the posting of emergency no parking signs: the Mayor, Police Chief, Commander of the Bureau of Transportation, Director of the Department of Public Works, the Superintendent of the Traffic and Signal Division and the Director of the Parking Utility. C. It shall be deemed to be reasonable notification to vehicles parked within the locations of the emergent condition by the posting of emergency/temporary regulation signs.

D. Any unoccupied vehicle parked or standing in violation of this chapter shall be deemed a nuisance and hazard, and any police officer may provide for the removal of said vehicle. The owner of the vehicle shall pay the reasonable costs for the removal and storage which may result from such removal before regaining possession of the vehicle.

E. Any owner or other person legally entitled to the return of any vehicle removed by the Police Department, Parking Authority or Parking Enforcement Bureau shall be required to pay, in addition to the full amount of fees chargeable for towing and storing of said vehicle, any fines, interest, penalties and costs that may be imposed under the terms of N.J.S.A. 39:4-139.13a through d and the terms of this chapter. F. The amount of any unpaid fees, the payment of which is required hereunder, shall constitute a debt due the Mayor and Council of the City of Hoboken and shall be collectible in the manner provided by law in a court of competent jurisdiction. [Added 11-6-1991 by Ord. No. P-164]

G. Any member of the Police Department, Parking Authority or Parking Enforcement Bureau may cause the immobilization or impoundment of such a vehicle found within the jurisdiction of the City of Hoboken, if there are any outstanding warrants against such vehicle. § 190-29. Definitions.

For purposes of Article XVII, the following definitions shall apply:

PAID PARKING SPACE — A space that is delineated on a public right-of-way for which payment is required to park a vehicle.

PAID PARKING ZONE — A group of parking spaces, on a public right-of-way or on city property, that are delineated by a posted sign and for which payment is required to park a vehicle.

PARKING METER — Any mechanical or electronic device that the city places or erects on city property, adjacent to a paid parking space for the purpose of managing and controlling the use of paid parking spaces and that requires payment for use.

PARKING OCCASION — The uninterrupted period of time that a vehicle is parked in a paid parking space or a paid parking zone while paid parking time limits are in effect.

PARKING PAY STATION — Any electronic device, except a parking meter, that the city places or erects on city property, for the purpose of managing and controlling the use of paid parking spaces and paid parking zones and that requires payment for use.

PAY AND DISPLAY STATION — A parking pay station that dispenses a receipt, as proof of payment, to be displayed as required Section 190-29.5F.

PAY BY SPACE STATION — A parking pay station that measures the lawful parking occasion and its expiration for specific paid parking spaces without issuing a receipt for display on a vehicle.





§ 190-29.1. Parking meters and parking pay stations.

A. The Department of Transportation and Parking may use parking meters and parking pay stations to assist in the enforcement of parking time restrictions.

B. A parking meter must:

(1) Be installed adjacent to the parking space it monitors or be labeled to indicate the space;

(2) Indicate the maximum uninterrupted time a vehicle may remain parked in the space during any parking occasion; and

(3) Display the amount of time a vehicle may remain legally parked in the space after the deposit of payment.

C. A parking pay station must:

(1) Be installed on the same city block or at the same city-owned or controlled parking lots or facilities as the paid parking space or paid parking zone it monitors;

(2) Indicates the maximum uninterrupted time a vehicle may remain parked within the paid parking space or the paid parking zone during any parking occasion; and

(3) Either:

(a) Measure and store the amount of time a vehicle may remain legally parked after the deposit of payment; or

(b) Issue a receipt that indicates the amount of time a vehicle may remain legally parked after the deposit of payment.

D. A parking meter or a parking pay station shall indicate the hours and days that paid parking time limits are in effect.

E. A parking meter or a parking pay station shall indicate the amount of the fee for parking a vehicle.

F. The Department of Transportation and Parking shall equip parking meters and parking pay stations to accept coins in denominations appropriate to pay the fee for parking a vehicle.





§ 190-29.2. Paid parking spaces and paid parking zones.

A. The Department of Transportation and Parking shall establish the location of paid parking spaces and paid parking zones on the streets and in city-owned or controlled parking lots or facilities where the City Traffic Engineer determines that the strict enforcement of parking time limits is appropriate.

B. The Department of Transportation and Parking may paint or mark each individual paid parking space to prevent encroachment into adjacent paid parking spaces.





§ 190-29.3. Parking in a paid parking space.

A. A person must park a vehicle completely within the delineated parking space.

B. A person may not park a vehicle in a paid parking space that is legally occupied by another vehicle.





§ 190-29.4. Time limits on paid parking.

A. Paid parking time limits are in effect from 9:00 a.m. to 9:00 p.m., Monday through Saturday, unless otherwise posted.

B. The Department of Transportation and Parking shall establish the maximum uninterrupted time a person may continuously park a vehicle for each parking occasion.

C. When paid parking time limits are in effect, a person may not park a vehicle for more than the maximum parking time limit established by the City Traffic Engineer for each parking occasion.

D. A vehicle may not be moved and reparked in the same paid parking space or paid parking zone to avoid violating the maximum parking time limit for each parking occasion.

E. When paid parking time limits are in effect, a person may not allow a vehicle to remain parked in a paid parking space or a paid parking zone when the authorized parking time has expired.

F. A person parking a motorcycle or moped is exempt from paying meter parking fees but may not exceed the maximum time allowed on the parking meter or parking pay station during a parking occasion at a paid parking space or paid parking zone.





§ 190-29.5. Fee due for parking vehicle.

A. Except as provided in Subsection B, a person parking a vehicle in a paid parking space or paid parking zone shall immediately pay the parking fee due.

B. This section does not apply to a person:

(1) Parking a vehicle defined by New Jersey Motor Vehicle Commission as a motorcycle or moped; or

(2) Occupying a parking space or parking zone as authorized by permit issued or approved by the Department of Transportation and Parking.

C. A person must deposit U.S. coins in denominations accepted by the parking meter or parking pay station or use a credit card, bank debit card, or a parking meter fee debit card to pay the parking fee.

D. A person may not use foreign currency in a parking meter or a parking pay station.

E. A person may not deposit more than the amount of payment necessary to obtain the maximum parking time limit allowed during a parking occasion.

F. If parking a vehicle in a space monitored by a pay and display station, a person shall immediately locate the pay station receipt on the dashboard inside of the vehicle's windshield adjacent to the curb.

(1) The receipt must be placed in a position so that it is as close to the sidewalk as possible and can be read from outside of the vehicle while standing on the sidewalk.

(2) No more than one (1) receipt shall be displayed in the windshield at a time.

(3) No other items shall be placed in proximity of the displayed receipt in such a way that they are confusing or impair the ability to read the receipt.

G. A person may not park at a paid parking space with an inoperable parking meter unless the person pays at the nearest pay and display station and locates the receipt to the window as required in Subsection F.

H. A person may not park in a paid parking zone monitored by a pay and display station without a receipt from the nearest operable pay and display station.

I. The minimum amount of parking time that may be purchased is fifteen (15) minutes.





§ 190-29.6. Holiday Exemptions.

A. Sections 190-29.4 (Time Limits on Paid Parking) and 190-29.6 (Fee Due for Parking Vehicle) do not apply on the following days:

(1) January 1;

(2) July 4;

(3) The first Monday in September;

(4) The last Thursday in November; and

(5) December 25.





§ 190-29.7. Credit card, bank debit card, and parking meter fee debit cards.

A. The Department of Transportation and Parking may equip a parking meter or a parking pay station to accept parking meter fee via debit cards, credit cards, or bank debit cards in addition to coins.

B. The Hoboken Parking Utility may issue a parking meter fee debit card for use in a parking meter and may establish rules to administer this section.

ARTICLE XXI School Crossing Guards



§ 190-33. Duties, salaries and positions.

There shall be created and is hereby created the position of part-time school crossing guard, the number of which is not to exceed thirty-five (35).



A. The power to appoint such part-time school crossing guards is hereby vested in the Director of the Department of Public Safety.

B. No person, male or female, shall be appointed to the position of part-time school crossing guard unless he or she:

(1) Is a citizen of this state.

(2) Is sound in mind and body.

(3) Is of good moral character.

(4) Has not been convicted of any criminal offense involving moral turpitude.

C. An adult school crossing guard shall not be a member of the Police Department or force of the municipality, and his powers and duties shall cease at the expiration of the term for which he was appointed. They shall not have the right to bear firearms or the power of arrest.

D. Every adult school crossing guard shall be under the supervision and direction of the Police Chief or his designee.

E. They shall comply with the rules and regulations applicable to the conduct and decorum of the regular police officers.

F. Before any such appointments, the Police Chief shall ascertain the eligibility of the applicant and make a report to the Director of the Department of Public Safety.

G. Every person appointed to the position of part-time school crossing guard shall be trained for the proper performance of their duties and responsibilities. Such training shall consist of a minimum of two (2) hours of classroom instruction, which shall include information on methods of traffic control and the duties and responsibilities of adult school crossing guards, and a minimum of twenty (20) hours of field training in which the trainee shall be supervised by an experienced adult school crossing guard or a regular police officer.

H. The Director of the Department of Public Safety shall provide a suitable uniform, distinct from members of the uniformed police force, to include but not limited to a safety vest, hat and breast and hat shields, which cost shall be borne by the City of Hoboken and shall be returned to the City of Hoboken upon termination of employment.

I. The Police Chief shall have the right to position adult school crossing guards on any street or highway, provided that such guards may be stationed only when it is necessary to control or direct vehicular or pedestrian traffic, during those time periods of a school day when it is necessary to control traffic or during any special event or program involving pedestrian crossings whenever it is deemed to be in the best interests of public safety.

J. Part-time school crossing guards shall not be employed in any calendar year for a period longer than one hundred eighty (180) school days, and their hours of employment during each school day shall consist of the following:

(1) 7:45 a.m. to 9:15 a.m.

(2) 11:15 a.m. to 1:15 p.m.

(3) 2:15 p.m. to 3:30 p.m.

K. There shall be created the position of part-time school crossing guard supervisor, with a per diem salary of nine dollars ($9.) per hour.

L. Each person so employed as a part-time school crossing guard shall receive a per diem salary of the following for each actual day of employment or such portion thereof, in the event that their services are required less than the hours prescribed in Subsection J of this section:

(1) First year: six dollars and fifty cents ($6.50) per hour.

(2) Second year: seven dollars ($7.) per hour.

(3) Third year: seven dollars and fifty cents ($7.50) per hour.

M. The Director of the Department of Public Safety shall have the power to promulgate such rules and regulations as he may deem advisable for the efficient operation of the part-time school crossing guards not inconsistent herewith.





ARTICLE XXII Towing of Vehicles

§ 190-34. General provisions.

A. The owners of all private property must post a permanent sign in clear view, free from any interference from any natural or man-made objects, every twenty-five (25) feet warning car owners that unauthorized vehicles will be towed from the premises.

B. The sign must also identify the name, address and phone number of the towing firm.

C. The sign must also identify the address and phone number where the car can be found.





§ 190-35. Violations and penalties.

Any private property owner or person in control of private property or any person permitting the removal of a motor vehicle from private property in violation of this Article shall be subject to a fine of two hundred dollars ($200.) for each violation.

§ 190-36. Snow emergencies.

A. Whenever snow has fallen and the accumulation is such that it covers the street or highway, an emergency shall exist and no vehicle shall be parked on the following street or highways or portion thereof.

B. The above parking prohibitions shall remain in effect after the snow has ceased, until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.





§ 190-37. Removal.

Any unoccupied vehicle parked or standing in violation of this Article shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer, and or parking enforcement officer may provide for the removal of such vehicles. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.





§ 190-38. Erection of signs.

The effectiveness of this Article is contingent upon signs being erected as required by law.





§ 190-39. Violations and penalties. [Amended 9-17-1997 by Ord. No. R-269]

Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation or provision of this Article or any supplement thereto shall be liable to a penalty of not more than fifty-one dollars ($51.).





ARTICLE XXIV Hazardous Recreational Activities

[Adopted 7-1-1996 as Ord. No. R-194]



§ 190-40. Reckless operation of roller skates, in-line skates and skateboards prohibited.

A. Definitions for purposes of this Article:

(1) IN-LINE SKATE - A manufactured or assembled device consisting of an upper portion that is intended to be secured to a human foot, with a frame or chassis attached along the length of the bottom of such upper portion, with such frame or chassis holding two (2) or more wheels that are longitudinally aligned and used to skate or glide, by means of human foot and leg power while having such device attached to each such foot or leg.

(2) HAZARDOUS RECREATIONAL ACTIVITY - A recreational activity conducted on property of the City of Hoboken which creates a substantial (as distinguished from a minor, trivial, or insignificant) risk of injury to a participant or a spectator, and by way of example, includes but is not limited to: bicycle racing or jumping, operating a motorized scooter, in-line skating, roller blading, roller skating, skateboarding.

(3) RECKLESS OPERATION - Operating roller skates, in-line skates, a skateboard or a motorized scooter on a public street, highway or sidewalk in such a manner which causes harm to the safety or property of another, or in the following manner:

(a) While holding on to other moving objects including but not limited to motor vehicles while skating; or

(b) Failing to ride as near to the right side of the roadway as practicable; or

(c) Failing to exercise due care when (i) passing vehicles and people, (ii) turning and (iii) stopping.

(4) ROLLER SKATE - A manufactured or assembled device consisting of a frame or shoe having clamps or straps or both for fastening, with a pair of small wheels near the toe and another pair at the heel mounted or permanently attached thereto, for skating or gliding by means of human foot and leg power.

(5) SIDEWALK - That portion of the street, whether paved or unpaved, between the curblines or the lateral line of a roadway and the adjacent property lines, intended for the use of pedestrians. Where it is not clear which section is intended for the use of pedestrians the sidewalk will be deemed to be that portion of the street between the building line and the curb.

(6) SKATEBOARD - A device consisting of a platform, usually curved upwards at each end, to which are mounted or permanently attached two (2) swiveling frames, each of which is used to support and guide a pair of small wheels, which device glides or is propelled by means of human foot or leg power.

B. No person shall engage in the reckless operation of roller skates, in-line skates, a skateboard or a motorized scooter.

C. Each violation of Subsection B of this section shall be a separate traffic infraction and shall be punishable accordingly. Any person who is found guilty of a violation of Subsection B shall be subject to a fine of not less than fifty dollars ($50.) nor more than one hundred dollars ($100.) or imprisonment for a term not exceeding five (5) days, or community service not in excess of one hundred (100) hours, or any combination of the above penalties.

D. The provisions of this section shall be enforced by the Police Department.





§ 190-40.1. Liability for participation in a hazardous recreational activity.

A. Neither the City of Hoboken nor a public employee or officer thereof is liable to any person who participates in a hazardous recreational activity, including any person who assists the participant, or to any spectator who knew or reasonably should have known that the hazardous recreational activity created a substantial risk of injury to himself or herself and was voluntarily in the place of risk, or having the ability to do so failed to leave, for any damage or injury to property or persons arising out of that hazardous recreational activity.

B. Notwithstanding the provisions of Subsection A, this section does not limit liability which would otherwise exist for any of the following:

(1) Failure of the City of Hoboken or an employee thereof to guard or warn of a known dangerous condition or of another hazardous recreational activity known to the public entity or employee that is not reasonably assumed by the participant as inherently a part of the hazardous recreational activity out of which the damage or injury arose.

(2) Injury suffered to the extent proximately caused by the negligent failure of the City of Hoboken or an employee thereof to properly construct or maintain in good repair any structure, recreational equipment or machinery utilized in the hazardous recreational activity out of which the damage or injury arose.

(3) An act of gross negligence by the City of Hoboken or an employee thereof which is the proximate cause of the injury.

C. Nothing in this section creates a duty of care or basis of liability for personal injury or for damage to personal property.

D. Nothing in this section shall limit the liability of a business enterprise or any person or organization other than the City of Hoboken, whether or not the enterprise, person or organization has a contractual relationship with the City of Hoboken to use the public property, for injuries or damages suffered in any case as a result of the operation of a hazardous recreational activity on public property by the enterprise, person, or organization.





ARTICLE XXV Signage Designating Driveways and Loading Zones [Adopted 4-2-1997 by Ord. No. R-237]



§ 190-41. Signage for restricted parking zones for driveways and loading zones.

A. The owner of any real property containing a driveway or loading zone and located within the city may make an application to the City Clerk for the installation of a sign designating the driveway or loading zone a restricted parking area.

B. Applications for the installation of the restricted parking signs referred to in Subsection A hereof may be obtained from and shall be filed with the City Clerk. The applicant shall also submit a fee of one hundred twenty-five dollars ($125.) to the City Clerk made payable to the City of Hoboken at the time said application is filed with the City Clerk. The City Clerk shall then forward all applications to the Business Administrator or his designated agent who shall investigate each application for compliance with state law and local ordinances. After the Business Administrator has determined compliance or noncompliance with state law and local ordinances, he shall then direct the Division of Traffic and Signals to install signage designating restricted parking on the property. Should the application be denied for noncompliance with governing laws, then the City Clerk shall refund the full amount of the application fee.

C. The Department of Administration Division of Traffic and Signals shall maintain a registry of all signs installed within the City of Hoboken for the purpose of designating restricted parking. All signs shall be installed in accordance with the standards set forth by the Uniform Traffic Code.

D. The City of Hoboken may, for good cause shown, established by ordinance restrict parking for a Loading Zone. It is provided that such parking is not otherwise prohibited and does not interfere with the normal flow of traffic. [Added 10-20-2004 by Ord. No. DR-164]

E. The term Loading Zone shall mean: No person shall park any vehicle in said location during the times indicated other than for the loading or unloading of goods and materials. Use is for a time limit of twenty (20) minutes, and the vehicle's four-way flashers must be on. [Added 10-20-2004 by Ord. No. DR-164]

F. The Parking and Transportation Committee and the Superintendent of Traffic and Signal shall review all requests for loading zones for compliance or noncompliance with the provisions of this Article. [Added 10-20-2004 by Ord. No. DR-164]

G. Loading zoning application shall require a demonstration of at least three (3) businesses in designated area within a radius of two hundred (200) feet. Consideration will be given to the type of businesses, the flow of patrons, and timing for delivery of goods. The hours and days of operation will be Monday to Friday 9:00 a.m. to 4:00 p.m. [Added 10-20-2004 by Ord. No. DR-164]

H. Proper signs shall be erected in accordance with the current Manual on Traffic Control Devices. [Added 10-20-2004 by Ord. No. DR-164]



§ 190-41.1. Parking in front of driveway. [Added 1-17-2007 by Ord. No. DR-288; amended 10-20-2010 by Ord. No. Z-63]

A. Pursuant to N.J.S.A. 39:4-138.4, the Director of the Parking Utility may issue to owners of private driveways and, in the case of a private residence to members of the same household, permits authorizing the parking of private passenger vehicles in front of the owner's driveway. The Director may require an owner to file a complete application for such a permit on a form provided by the Director. An owner of a private driveway shall be eligible to apply for up to three (3) permits for his or her own motor vehicles or for use by other parties authorized by the owner to park in front of the private driveway. In the case of a private residence, each member of the owner's household who owns a motor vehicle shall also be eligible to apply for a permit issued under this section. The Director may require an applicant to provide evidence that the driveway was legally established in accordance with the municipal Zoning Code.

B. The permit shall identify the location of the driveway and the vehicle authorized to park in front of the driveway. The permit shall be five and one-half inches by eight and one-half (5 1/2 x 8 1/2) inches in size. Shall bear an appropriate certification of authenticity and shall be displayed prominently within the vehicle when parked so as to be seen from the middle of the street.

C. Provided that such parking is not otherwise prohibited and does not interfere with a normal flow of traffic, it is an affirmative defense to prosecution for violation of N.J.S.A. 39:4-138(d) if:

(1) The parked vehicle and driveway where the vehicle is parked are owned by the same person; or

(2) The parked vehicle is owned by a member of the same household as the owner of the private driveway; or

(3) The owner of the private driveway authorized the parking of the parked vehicle in front of the private driveway; or

(4) This defense may be presented by form of affidavit as provided for in the New Jersey Court Rule 7:6-6(a); or

(5) The rights of this parking permit shall supersede all other parking permit regulations, which are found in Hoboken General Code Section 190-6.2 and 141A-2H.

D. No owner may permit any vehicle to park in front of the owner's driveway without a valid driveway parking permit displayed prominently within the vehicle when parked so as to be seen from the middle of the street.

E. No owner may charge a fee for permitting anyone to park a vehicle in front of the owner's driveway.

F. The parked vehicle must be parked parallel to the curb in front of the driveway. No vehicle shall be parked in such a way as to block access to the sidewalk.

ARTICLE XXX Severability; Repealer



§ 190-43. Severability; repealer.

If any part or parts of this chapter are for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter. All former traffic ordinances of the City of Hoboken are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act committed in violation of any ordinance.

ARTICLE XXXII Vehicle Noise Restrictions



§ 190-45. Noise restrictions. [Added 1-19-2000 by Ord. No. R-418; amended 3-1-2000 by Ord. No. R-424]

A. General provisions and standards. No person shall make, continue, or cause to be made or continued, any loud, unnecessary, and/or prolonged noise derived from a vehicle or any such noise which annoys, disturbs, injures, or endangers the comfort, health, welfare, peace, or safety of others.

B. Horns and signaling devices. Noises such as these which emanate from a vehicle are hereby declared to be loud, disturbing, and unnecessary noises in violation of this Article.

(1) The sounding of any horn or signaling device on any vehicle, automobile, truck, motorcycle, moped, bus, public conveyance, bicycle, or other vehicle on any street or public place of the city, except as a danger warning or in the case of an emergency, is strictly prohibited.

(2) The creation by means of any such horn or signaling device of any unreasonably loud or harsh sound, except as a danger warning or in the case of an emergency, is strictly prohibited.

(3) The sounding of any such device for an unnecessary and unreasonable period of time is strictly prohibited.

(4) The uses of any horn, signaling device, whistle, bell, or other such device, except as a danger warning or in the case of an emergency, is strictly prohibited.

C. Exhaust. The discharge into the open air of the exhaust of any steam engine, stationary internal combustion engine, motorboat, motor vehicle, motorcycle, or moped, except through a muffler or other device which will effectively prevent loud or explosive noises therefrom.

D. Any person who violates any provision of this section or any rule promulgated hereunder shall be liable to a fine of not less than seventy-five dollars ($75.) nor more than three hundred fifty dollars ($350.). For the first offense of this Article, a penalty of seventy-five dollars ($75.) shall be imposed. For the second offense of this Article, a penalty of one hundred fifty dollars ($150.) shall be imposed. Each and every subsequent offense of this Article shall be a matter of judicial discretion and/or determination. Each day a violation of this Article shall continue shall constitute a separate offense.





ARTICLE XXXIII Bicycle Lanes

§ 190-46. Scope.

The provisions of this section shall apply whenever a bicycle is operated upon any street or upon any public way within the City of Hoboken, subject only to those exceptions stated in this section.





§ 190-47. Streets designated.

A. Street segments with sufficient adjacent right-of-way shall be considered acceptable for installation of Class I bicycle lanes physically separated from the street consisting of a five (5) foot wide bicycle lane per travel direction demarcated with solid white lane striping and yellow striping bifurcating opposing bicycle travel lanes; these lanes shall include standard bicycle symbols painted on the street and optional contrast coloring within the bike lanes clearly indicating the space as a bicycle lane.

B. Streets segments with a travel lane of fifteen (15) feet or greater shall be considered acceptable for installation of Class II bicycle lanes consisting of a five (5) foot wide bicycle lane demarcated with solid white line lane striping; these lanes shall include standard bicycle symbols painted on the street and optional contrast coloring within the bike lanes clearly indicating the space as a bicycle lane.

C. Streets segments with a travel lane of less than fifteen (15) feet or with traffic patterns that make Class I or II bicycle lanes impractical, shall be considered acceptable for installation of Class III bicycle route markings consisting of standard bicycle symbols and double chevrons, also known as sharrows, painted on the street to communicate that drivers shall share the road with bicyclists; these routes shall also include “Share the Road” posted signage.

D. Street designations and typical lane configurations are meant to be standard guidelines; however, all final bicycle lane and route configurations are subject to professional review and recommendation by the Department of Transportation and Parking, and shall be included in the City Code.

§ 190-48. Lane configuration.

A. Class I bicycle lanes shall be separated from vehicle traffic by a curb or median.

B. Class II bicycle lanes shall be located on the right side of two-way streets and the left side of one-way streets, between parking and travel lanes.

C. Class III bicycle routes shall offset markings to the right of the travel lane center line so that bicyclists are guided outside of the door sweep area of parked cars.

D. Appropriate striping, pavement markings, and/or signage shall be used at intersections where streets transition between one-way and two-way traffic flow.





§ 190-49. Application of traffic laws to bicycles.

Every person riding a bicycle upon a roadway shall be granted all the rights and shall be subject to all the duties applicable to the driver of a vehicle by the laws of this state and the traffic provisions of this Code applicable to the driver of a vehicle, except as to special regulations in this Article and except as to those provisions of laws and ordinances which by their nature are inapplicable to such persons.





§ 190-50. Bicycle rules and regulations.

A. Obedience to traffic control devices.

(1) Any person operating a bicycle shall obey the instructions of official traffic control signs, and other control devices applicable to vehicles, unless otherwise directed by a police officer.

(2) Whenever authorized signs are erected indicating that a turning movement is restricted no person operating a bicycle shall disobey the direction of any such sign, except where that person dismounts from the bicycle to make the turn, in which event such person shall then obey the regulations applicable to pedestrians.

(3) No person shall ride or operate a bicycle in any direction except that permitted of vehicular traffic traveling on the same side of the roadway.

(4) Any person operating a bicycle shall stop for pedestrians in crosswalks.

B. Riding on roadways and bicycle paths generally.

(1) Every person operating a bicycle upon a roadway shall ride as near to the right hand side of the roadway as practicable, exercising due care when passing a standing vehicle or a vehicle proceeding in the same direction, unless an exclusive bicycle lane is provided.

(2) Persons riding bicycles upon a roadway shall not ride more than two (2) abreast except on paths or parts of roadways set aside for the exclusive use of bicycles.

(3) Whenever a bicycle lane has been established on a roadway, any person operating a bicycle upon the roadway at a speed less than the normal speed of traffic moving in the same direction shall ride within the bicycle lane, except that such person may move out of the lane under any of the following situations:

(a) Whenever overtaking or passing another bicycle, vehicle or pedestrian within the lane or about to enter the lane if such overtaking and passing cannot be done safely within the lane.

(b) When preparing for a turn at an intersection or into a private road or driveway.

(c) When reasonably necessary to leave the bicycle lane to avoid debris or other hazardous conditions.

C. Manner of riding bicycle.

(1) A person propelling a bicycle shall not ride other than astride a permanent and regular seat attached thereto.

(2) No bicycle shall be used to carry more persons at one time than the number for which it is designed and equipped.

D. Speed restrictions. No person shall operate a bicycle at a speed greater than is reasonable and prudent under the condition then existing.

E. Yielding right-of-way from bicycle path or sidewalks. Every person riding a bicycle on a bike path or sidewalk that is about to enter or cross a roadway shall yield the right-of-way to all traffic on such roadway.

F. Leaving bicycle lanes. No person operating a bicycle shall leave a bicycle lane until the movement can be made with reasonable safety and then only after giving an appropriate signal.

G. Motor vehicles in bicycle lanes. Whenever a bicycle lane has been established on a roadway any person operating a motor vehicle on such a roadway shall not drive or park in the bicycle lane except for the purposes of performing a parking maneuver where parking is permitted, to enter or leave the roadway, or to maneuver around a parked vehicle impeding traffic flow.

H. Bicycles emerging from alleys or driveways; yielding right-of-way. The operator of a bicycle emerging from an alley, driveway, or building, shall, upon approaching a sidewalk area extending across any alleyway or driveway, yield the right-of-way to all pedestrians approaching on the sidewalk or sidewalk area. Upon entering the roadway the operator shall yield the right-of-way to all vehicles approaching on the roadway.

I. Clinging to vehicles prohibited. No person riding upon any bicycle shall attach the same or himself to any streetcar or vehicle upon a roadway.

J. Riding on sidewalks.

(1) No person shall ride a bicycle upon a sidewalk at a speed greater than the walking speed of pedestrians.

(2) Persons riding a bicycle upon a sidewalk shall yield the right-of-way to any pedestrian and shall give an audible signal before overtaking and passing any pedestrian.

(3) Persons riding a bicycle upon a sidewalk shall keep as close to the curb as is practicable to allow pedestrians to walk along sidewalks without impedance.

K. Carrying articles. No person operating a bicycle shall carry any package, bundle, or article which prevents the rider from keeping at least one hand upon the handlebars.

L. Parking. No person shall park a bicycle upon a street other than upon the roadway against the curb or upon the sidewalk in a rack to support the bicycle, or against a building or at the curb in such manner as to afford the least obstruction to pedestrian traffic.

M. Lamps and equipment on bicycles.

(1) Bicycles in use at nighttime shall be equipped with a lamp on the front which shall emit a white light visible from a distance of at least five hundred (500) feet to the front and with a red reflector on the rear of a type which shall be visible from fifty (50) feet to three hundred (300) feet to the rear. A lamp emitting a red light visible from a distance of five hundred (500) feet to the rear may be used in addition to the red reflector.

(2) A bicycle shall not be equipped with, nor shall any person use, any siren or whistle upon a bicycle.

(3) Bicycles shall be equipped with a brake which will enable the operator to make the braked wheel skid on dry, level, clean pavement.

(4) Bicycles may be equipped with a bell to serve as audible signal for the purposes of overtaking and passing any pedestrian or other bicycles.





§ 190-51. Other users of bicycle lanes.



In addition to bicycle riders, individuals using roller blades, motorized wheelchairs with an orange safety flag at least five (5) feet above street level, and bicyclers with attached trailers for children will also have the same orange safety flag attached to the rear of the portage vehicle, shall also be permitted to use the bicycle lanes.





§ 190-52. Penalties.

In the event that any individual violates the terms of this section he/she shall be subject to a fine in the Municipal Court of the City of Hoboken in an amount of one hundred dollars ($100.) for the first offense and two hundred dollars ($200.) per violation for any subsequent offenses.
